Codicil, Restatement, or New Will?

The appropriate document depends on the language of your current will and the extent of the proposed changes. A codicil may work for a focused update, while extensive or interconnected revisions may call for a restatement or an entirely new will.

Handwritten edits and informal notes don’t automatically change a will under California law. A formally prepared document can clarify the intended update and reduce the risk of conflicts with other provisions.

Choosing Between a Codicil & a New Will

A codicil typically addresses one or more focused changes without replacing the original will. Because both documents are read together, this approach can become difficult to follow when several provisions change or earlier codicils already exist.

A restatement or new will may be more appropriate when revisions are extensive, the original language is unclear, or several provisions must work together under new circumstances. We examine the complete document and proposed updates before explaining which approach may fit the situation.

California Rules for Signing a Codicil

California law generally provides that a formal written will must be signed by the testator, meaning the person making the will, and witnessed by at least two people who are present at the same time. The witnesses generally must understand that the document is the testator’s will and sign during the testator’s lifetime. Because a codicil operates together with the original will, it should be prepared and signed with the same attention to applicable formalities.

California also recognizes a holographic will when the signature and material provisions are handwritten and statutory conditions are met. That rule doesn’t mean handwritten changes to an existing typed will automatically create a valid amendment. Witness selection also matters because a gift to an interested witness can trigger a legal presumption in certain circumstances.
