Under California Probate Code section 17200, a trustee or beneficiary may petition the probate court about certain internal trust matters. Depending on the facts, the petition may seek an accounting, instructions to a trustee, interpretation of trust terms, trustee removal, or relief for an alleged breach of trust.
Some conflicts can be addressed through negotiation or mediation, a structured settlement process led by a neutral third party. Others proceed through court hearings, discovery (the formal exchange of evidence), trial, or enforcement after judgment. The appropriate parties, evidence, filing, and timeline depend on the document, the claim, any notice received, and whether a related probate case is pending.
